Q: DV case not withdrawn after the first motion

I and my wife have settled our case in Mediation centre Court. As per the terms & conditions she has to withdraw DV act within a week after first motion and FIR quashing will be done after second motion. The amount is to be paid in 3 instalments, 1st instalment on 1st motion, 2nd instalment on 2nd motion & 3rd instalment on FIR quashing. Our 1st motion was done on 23rd July,18 in which we have given her amount as agreed. But till date, she has not withdrawn the DV act case. Also, she has not appeared on the next date of hearing in DV act case which was on 9th Aug,18. Her advocate is also not appearing now. In the first motion, we have submitted the affidavit in the family court in which we have mentioned that if any party breaks the settlement deed in between then they have to pay a certain amount to the second party and also return back the amount taken. So, I want to know what action can we take against her now? Please tell me the section no. of IPC which is to be put in this case on wife by me.

Ok As per your query it seems that there is a clear settelment between both the parties. But she is failed to complete it, I hope you have an agreement of settlement , which is full signed by both the parties, if yes and still she is failed to perform it, in that case you can file contempt of court against her as she breach the agreement.. for any further queries you can contact me.



Q: Register case as boyfriend makes false promise to marry & refuses

Hi,i am in 3years of relationship with a man.early days of relationship he told me that he will marry me and then our families met eachother during this we had sexual relations.now he and his family demanding money to get married and when we denied for money they refused for marriage even the boy supports his family.and in early days of relationship I have told him that we don't able to give money we can do simple wedding.so what r the charges will take against him and we did it in other city and I am living in other city so if I lodge an fir in my city so where they will registered a case or where they will take statement i mean it solve in my city or other city where we did it.

See, as per law if both the parties are mature enough then there is no question u can arise about making sexual relation on promise to get marry..in that point law will not support you, further what you can do is, if they demand money you can file a dowry demand case against them.. and yes you can register FIR in your City... I m married since 2008 by Hindu rituals and staying away from my husband from past 4-5 years just because of his bad behavior,drinking habits and physical abuses . I want to file a divorce but no-one is in my support not even my parents . I have lost my jobs My friends family everything just because of this person. He is not ready to leave me. No,Arrested for wat ??Wat offence as per U has he committed ?? Adultery is still an offence under the IPC. Informing anyone of the same, offline or online, generally is not an offense.Reconcile or file or separation / divorce. I don't see him getting implicated legally just based on these facts...
