Q: One of my father's land under mortgage since 12 years

my father took 1L rupees and registered that documents and the one who gave money to my father also took sign in another page (12 years back).my parents are ready to pay 5Lakhs money to him.But he is demanding 10Lakhs. But in EC it will come his name.Is anything problem is tghis sir?please suggest me sir my father is a heart patient

If Mortgage was registered, it will comes mortgagee name in EC. You can file a Release Mortgage deed. Ask politly yours documents. if you have mortgage deed documents read that how many years of mortgage. read the deed of mortgage.



Q: Children have equal right to share in father's self acquired property

Hello Sir/Madam, I'm  from Hyderabad,Telangana .I have a question regarding the property rights of the house that was built by grand father (father of my mom), my mom have three siblings two brothers and one sister. we all live in the same house since the house is built my grandfather himself ,my mom is divorced and my aunt i.e younger sister of my mom is still never married.both the brothers of my mom are married , the daughter in laws of the grand father are fighting with my mom and aunt to go out of the house and we(me,my mom and aunt) don't have any other properties both the sons of my grandfather have other property . so my question is does every child have equal right over the property of their father which is self acquired house (whether son or daughter)? can we my mom and my aunt have any rights to claim over the house ? please guide us with a advice sir/madam we are in trouble.

yes, Children have equal right to share in father`s self acquired property.This Property belongs to your`s grandfathers self acquired property.Father`s children have equal share. so everyone has equal share under the act.
