Q: Difference between divorce decree received u/s 7 and u/s 13
BACKGROUND: Me and my wife belong to Hindu religion. When we got married, my wife had "Deed of Divorce" (she did not have a court decree and this was 2nd marriage for me and my wife). I filed for her visa petition but US immigration dept demanded to submit her court decree which she did. Unfortunately, her visa petition denied because US immigration dept said "she was not legally eligible / free to remarry". QUESTION: What is the difference between a court decree received under Section 7 and Section 13? Are both considered legally valid in India and abroad (for US visa purpose)?

Sec 7 is for to get divorce decree from the court in which you are saying that in your custom taking divorce on stamp paper by divorce deed is valid and to apply in govt authority u need decree so court after consider all relevant facts can pass an order of divorce decree and judgment and Sec 13 is a divorce petition u can file under relevant ground and sec 13 b is for the mutual divorce petition in which you can get divorce decree within certain time

Yes obviously you can file divorce under the ground of adultery and right now courts also considering electric proofs as the valid proof and sms and email conversations also can be considered to proove emotional attachement with another guy so yes u can get divorce from cheater wife

Hi you can apply it where your place of residence is in india u can go through marriage under special act and after applying the same you have to wait for 30 days in case of special marriage Act and after that your marriage can be done and you get the certificate too.
