Q: Breach of trust by property buyer and he sold my propery to did. Prsn

Hi experts,nI entered into an agreement of sale for my property with a person. He paid me some amount as earnest money and made an entry on the agreement for the same. He asked for 4 Months' time for full payment/registry and we agreed. After time collapsed on the sale agreement he started harassing me and breach the agreement. nnA) He never paid the entire earnest money ( I dont have this amount written in agreement but I have whatsapp chats with the person regarding the same ) nnB) Recently, I recieved some unknown RTGS in my account after 2 months of the expiration of sale agreement. This person is calling me and saying that the person with whom I entered into the agreement sold this property to him and now he will go ahead with the deal. nC) I noticed in my agreement that there is a clause saying that "buyer can get transferred this property to anyone or his name and make any profit out of it" nI don't want to deal with these fraudsters because it's been more than 7 months

Advocate Meenu Ojha Sharma answered
First of all before signing any document you should study it thoroughly just because it will take your little time we avoid reading it and on verge of the dealing person we sign it later on we regret over it! So its better to give the little time on reading the document instead of giving the time on regretting it! Its just an advice for you... you are not bound to follow it. Further, the legal advice for your current situation is to give a legal notice and also do complaint to nearest PS for fraud and breach of contract agsinst a person with whom you are in agreement and also the third person who is calling you saying that he has purchased the property further after giving them notice you can file the criminal as well as civil case against against them for breach of contract

Q: I have a Plot In Dehradun Which Is Said be An Inherited Property.

I have a plot in dehradun same considered to be an inherited property. Though, I had a plan to sell it but an advocate maliciously put up an application to stay, and allegedly stating that I conspired with local Gundas to occupy government property also which is located next to my property. So, my question is whether he has a right to put up a stay on my selling right of the aforesaid property..and what step that I can take against the advocate?

Advocate Meenu Ojha Sharma answered
If you have the proper documentation of the said property than you should first file a complaint against the same also make the boundry line of your property so that easily it can be recognised. Also engage an advocate file the reply to the application of stay and argue the same for you.

Q: MCD is asking me 32000rs for a demolition

MCD demolished a washroom being constructed on my terrace, it took 20 minutes to break down the 4 walls. Now I have got a notice from MCD demanding rs32000 which is much higher than rs5600 per hour. How can I save myself?

Advocate Meenu Ojha Sharma answered
First of all is there any notice from MCD for demolition of washroom and fine. If no then you should send them a legal notice for demolishing the washroom and also without any prior information or show cause notice. Also you can do complaint in the near by police station. Before that take the photos of the same area where the washroom is and now demolished. And also you should reply to the demand notice of MCD!
