Q: Selling a property in the name of a deceased father

My father died last year. He has a piece of land that we intend to sell. We are 2 brothers and my mother is also alive. All are in agreement for the sale. My question is - Since one of the brother lives outside Delhi and cannot travel frequently to Delhi, if we get a seller, can the property directly be transferred to the buyer? Or does the property need to be first registered in all 3 names (mother and 3 sons) and then second step will be to sell it (this will be longer and may mean multiple visits to Delhi)

In this you and your family members can make a Relinquishment deed and for that one has to go to sub-registrar's office only for once . By making a Relinquishment deed and register it in sub registrar office you can relinquish your right in the name of one member. After that only member is entitled to sell the property



Q: Finding a solution to my married life can be through a divorce too

Hi...I'm married for over a year now..my husband was never good to me throughout..he mentally, verbally, emotionally and physically abused me several times..either I'm aware of his income or work area..he hardly stays at home too... whatever time he stays at home he keeps criticising, abusing or taunting me all the time..he even disrespects my opinions and never involve me into any issues..kindly please help me on what to do as my mental health has been very down.

you can file several cases against him like maintenance and can approach administration to file FIR under section 498 etc. And when he comes to home and started fighting with you, Call the Police at the same time.Also you can file divorce, for further information you can contact me.

What is the Duration and minimum n maximum expenditure involved in mutual divorce

You can file mutual consent divorce under section. 13B (2) HMA and maximum period is of six months however you can file an application to waive the six months period. So that you will be able to get both the motions with in 10-15 days. Expenditure will be 35,000



Q: A guy is threating and hitting me.

A guy i was dating wants me to stay in his life no matter what goes right or wrong. He puts me in guilt n confusion every second so much so that i feel like ending my life. He hits me everytime and since i am scared saying this to my parents he threatens me in their name as well. He never let me study and go my classes. He is ruling my life. I need help. What shall i do? Whom should i go for help?

Go to police station immediately or call 100 at the time he will start fighting with you. The police will immediately register a fir in his name or if police is not helping you and did not register the FIR then you can file 156(3) Crpc

You can file restitution of conjugal rights u/s 9 of Hindu marriage Act and also you can file a police complaint in the concerned police station. Moreover you can also settle the matter amicably by filing divorce by mutual consent or if the wife is not ready go for contested divorce
