Q: cheque bounce case time limit after sending legal notice

I have sent a legal notice on 23 Sep. What is limitation period for filing cheque bounce case? Do i have time to file case against the other party in138 NI Act?

Yes you can, but you have to give a very strong reason to explain the delay.Moreover 30 days begin from the date of receipt of notice by the addressee and not from the date of sending of legal notice. Secondly even of court does not allows to file the case after wxpiry of 30 days., ypu can still go for summary suit which is a kind of recovery suit. Thirdly you can also put pressure on opposite party through various other means. Like various other remedies also exist in case of cheque bounce. Like in case of opposite partt being a company, there exist a remedy which only very few advocate knows.So it depends on the facts of the case as to how should we proceed a case. My dad created a firm in my mother\'s name, she has two cases filed against her under 138NI but all the activities were performed by my father. Now that he has passed away what can I do to avoid imprisonment and get some time for payment

If the firm is in your mother’s name, then your father’s death will make no difference on the case. Even if your father was actually controlling all the affairs of the firm, on paper, your mother is the proprietor. So case will go on as it is against your mother. Q: Complete charges for filling a case in consumer court

I would like to know the charges including court fees and lawyer fees for a case in consumer court for getting the refund of 220000/- \ncharges until the case is closed.

Charges would be 50,000 plus 1,500 per hearing charges and court fees on actual basis. But the fees depends on complexity in the case as well. But this is general overview of the fees. I have dealt with more than 700 cases before consumer court and have regular appearance there

Q: Legal notice for repayment of debt

I have to send a legal notice to three parties who I have been associated with in the past, and they haven't paid the money they took as a form of debt from me. Problem is I don't wish to provide them with any of my or my lawyer's details. So, is it possible to ask them to deposit the mentioned amount in the court from wherein I can receive it and does legal notices include lawyer's details or can be avoided?

It is not possible to file the case and hide the information of client or his advocate from opposite party. These details cannot be confidential. Moreover there is a fix period in which you can recover your debt. After expiration of the said period you would not be able to recover the same.
