Builder agreed to construct house took advance money and further denied, when ever we contacted him he confirmed he will pay but never paid, he also gave us 2 cheque and both of them got dishoured twice, it is more than year now, still he is telling he will pay but not paying. We don\'t have any other details other than his mobile no and since location is around 300 km away we could not regularly vist place and trace him

Advocate Manjula A answered
You have to find out his address. Nothing can be done without that. You can file a suit against him, assuming he wasn't registered with RERA. In fact RERA makes it much easier. Do you have an agreement? That would mention a lot of his details.

My wife filed section 9 (mentioned in document that ... given 40 lakhs cash to my parents hand and extra dowry harassment. She also mentioned that she found I am inactive in leading matrimonial life) which is 100% false case. I also filed section 13 1 (ia) but I didn\'t know she filed the case before me. Case was hearing. Now she countered to my case he was an impotent. How to move forward now, please provide strategy of her false allegations. Did I go for impotent test? How to pass the test?

Advocate Manjula A answered
The burden of proving her allegations falls on her. You can state the truth and ask her to prove her contentions. You need to prove your allegations. You must have made various statements in your petition about how she committed cruelty against you. You need to prove those statements. Further she might be helping you by making various false allegations and then failing to prove them.

Advocate Manjula A answered
This is very difficult to believe because you must have signed the petition and proof affidavit and various other documents. You might still be under some misconception. Please obtain a copy of the order that was passed in your case and show it to an advocate. If really you obtained a divorce decree unknowingly, your remedy is very complicated and involves multiple proceedings. please verify and get back

Advocate Manjula A answered
please let us know what kind of accident he met with? was it a road accident? was it some kind of accident that happened in the course of his work. does he have insurance? if your answer is yes, he should try getting compensation or insurance first. Further, for claiming maintenance from wife we also need to know under which law they got married. the Hindu Marriage Act does have a provision for husband seeking maintenance in certain exceptional cases. other laws don't
