Q: Excessive late fees fine by private college

I m doing pgdm from imm delhi college and I take a loan from pnb bank and it take 2 month to approved which cross me 1st installment date and they late fee fine 65k (500 /day ) and after I submit first they 2installment date come with in a month and I was unable to pay that time and than they fine me 31k for late submissio and has a rule that we have submit 5%of installment before dispersed that total 5.76lkh rupees out of total fees 8.76lkh and I m belong from ews category.

Our case ( complainant) has settled in district court Mediation as execution, D.V and 498 - A cases are still pending to be withdrawn by us. Now other party has stopped responding and not proceeding with court's order and signing on first motion affidavit which means ignoring the settlement agreement. What can be done in this situation and obligate them to complete the settlement by making the agreed payment.

"A" filed a 138 NI complaint case against "B" saying the transaction as Friendly loan though loan agreement, but later "A" filed FIR 420/406 , highlighting the transaction as fraud done through housing investment scheme and saying that friendly loan agreement was part of conspiracy to gain "A" confidence and to cheat "A".Though "B" admitted liability and settled, and made statement but didn't make any payment.Can both complaint sustain ? Can "A" add up the missing part in his Examination ?
