criminal case mai koi limitation nahi hoti, Ager police FIR nahi file kerti toh aap ek complaint National/ state commission for women and child, National commission for protection of Child right ya, CWC child welfare committee mai dek sakti hai, ya phir complaint directly Magistrate, POSCO court k pass bhi dek sakti hai. Police wale kaam na kerna parere issliye esa bol rahe hai esa kuch bhi nahi hota. Law aap ko protect kerne k liye hai darane k liye nahi.
Q: Gratuity not paid by employer after resignation
I worked in a private dental college in ghaziabad as a teaching faculty continuously for more than 10 years. But after my resignation the employer didn't pay any gratuity. I wanted to know whether I am eligible for gratuity or not.
Advocate Manisha answered
first you have to see that you are employee of that hospital not consultant or on contract, and there are more then 10 employees working in hospital. if both categories are fulfill you are eligible for gratuity, first send legal notice to the hospital if no reply filed or payment made then file complaint before labour commissioner or controlling authority
