Q: 498a quashing in high court after exparte divorce

My friend's husband is threatened her that he will go for 498a quashing in High court as he took an exparte divorce in 2019 but she come to know about this in 2021 so she has filed petion under order IX rule 13 for set aside and 498a from her current location.Question is what she can do here to stop him for 498a quashing.

Q: help in matrimonial issue between husband and wife

I am married from last 3 years. After a year of love affair we got married. It's the 2nd marriage for her  and she is 10 years older than me as well. She has twin kids and both are studying in class 11th in Dehradun. Initially it was difficult to convince the kids about our marriage, but after a lot of effort we were able to convince them and my family as well.As a man I wanted to be a father of my own kid. We discussed about it. Consulted a doctor as she is 43, and I personally don't wanna take any risk on her health. Medically we both are fit to be parents according to the doctor.Last year she conceived. We were very happy and planning our life ahead. But suddenly things got messy. Hello, nI need a legal advice. I got married on 16 April, 2022. My husband is Canada's Citizen. My husband lived with me for one month after our marriage, before flying back to Canada. I live with my inlaws and now they are harassing me for bringing 1 crore from my parents so that husband can open his business in Canada. Also my husband blackmails me that he will not apply for my spousal visa unless untill they get the money they ask. I also have the recording of my mother in law in which she is again n again abusing me and my family and is asking for the money. Kindly advice what can I do in this case. nThank You

There are many things but it’s depend upon what do you want to do.You can file cases against your husband and your in laws such as criminal complaint, domestic violence and divorce if you want to.What relief do you want then only I can suggest you better

rape victim want to transfer her case trail from noida court to gurgaon or delhi court. Is it possible?

Yes it is possible Jurisdiction depends on the residence of the victimIt is for the convenience of the victim If she resides in delhi then the case will be transfer to delhi so it totally depends on where the victim resides

Q: Whether i will get my money back from my husband

My husband filed section 9 against me from Mumbai after 1 month i filed 125 crpc maintenance case from Bareilly.I have 2 months old son that's why i didn't go to attend his hearing .1 year of arrange marriage only.My parents gave 10 lakh cash money but no proof and some gifts.Iam working and husband is working.Whether i will get maintenance for me and my son?nWhether i will get money and gifts back ?nWhen to file interim maintenance?

Yes you can file an application in a divorce petition which is already pending before the family court or you can file a separate petition for interim maintenance before another court You have both options And wife is eligible to get maintenance from husband accordingly
