Q: Forging estranged wife's signatures to withdraw money
My husband- a serving army officer and residing in a different state, and I are separated since Sept 2014 and our divorce and DV cases are subjudice. Now my husband has forged my signatures to foreclose my insurance policy and has taken the payment. 1. Should I first lodge an FIR and then approach the court or should I directly file a forgery case U/S 468? Any other sections that should be included? 2. Will the onus of proving that the signature is not mine lie on me? 3. What is the legal mechanism for proving whose signature it is?

You first file a complaint with the Police station under whose jurisdiction the Crime was committed or at the Place where you are residing presently. The police will take care of the provisions of law.
Q: Remedy as father's share of ancestral property claimed by his brother
Hi, My dad past away last year and now his brother claims that the property is in is name. So, would request you to suggest what to do further. Our grandfather is alive and he is not confirming anything about the property. Also, we have one floor wherein my dad is co-owner with his brother. Need further assistance

If the property is ancestral property, in that case you have a right by birth to claim a share by way of partition. However since your Uncle is laying claims over the share of your father and your grandfather is just a silent spectator as you have written. Moreover your dad was co-owner with his brother in one floor, in that case too you can seek partition of your share. The question is where your grandfather is the owner of the property and if he is alive then you cannot ask for a partition in his life time unless he has also inherited the property as an ancestral property and it is not his individual property. In either of the cases for the time being you can serve a legal notice demanding partition and wait for the response in which you will probably know the exact status of the nature of the property. Unless you have the title documents of the properties in question it is not advisable to file a suit for partition immediately. You need to do some more research and homework about the exact nature and status of the title which you can verify by visiting the Sub-Registrar's office concerned in which the said properties are registered.
Q: Procedure to file divorce and proceed with second marriage.
I am in love with another woman who is also married. what can we do as we both love each other

If you are already married, then try not to get involved with another married person. It is not only going to have bad results, but is an offence too. Try to make your first marriage work. If not, then only try to seek a divorce by mutual consent, after you talk to each other and settle all your difference in the first marriage. Then only think of a second marriage.

Hii sir i love a girl and she loves me too. we want to marriage each other. But her family is not ready for this marriage and they threaten their girl . My age is 21 and she is 16 plz help me

As per the law of the land, the age of individuals for getting married , for a male is 21 years and for a female it is 18 years which is the minimum age required. if you attain the age of majority and consent, the girl may choose to marry you according to your religion or you can go for a marriage under the Special Marriage Act 1954.
Q: Company wrongfully filed case of non payment
I have done disconnection with TK broadband , in 2015 , with F &F as 1500 INR. But this amount is for not submitting set up box, but I have submitted them , I have mail proof of receipt from their agent. They are threatening about case in Delhi, the mail proof is fine??? And if they file case on me , I have to come Delhi and report, if I am genuine will they pay my transportation and food expenditure??? Because for 1500 INR I have to pay 5000 INR ,.

As you have made the entire payment in lieu of the outstanding amount for the set-up-box connection, amounting to Rs.1500/-, on the demand of your Service Provider i.e. by T.K. Broadband Connection in 2015. Therefore, if you have Receipt of the payment made by you, it is advisable to keep that safely so that it is handy whenever required, as i.e. the only proof of your payment. Further, since you have already made the payment of the outstanding amount, in case any further demand or legal action is initiated against you, by the service provider, as threatened, then the said Receipt can be produced in your defense. Even otherwise you have an alternative additional remedy to file a consumer complaint before the Consumer Forum regarding the unfair/ restricted trade practice adopted by the Service Provider, claiming damages.
