What action bank can take in this situation. ? What can I do to get it defer for sometime or settle on low EMI.Thanks & RegardsRupesh Nigam

Advocate Kunal Vajani answered
Kindly reach out the concerned Bank Officers for surrendering the Credit Card and also arriving at a settlement for payment installments of smaller amounts by way of post dated cheques. There is also an option to have the outstanding amount of debt converted into a term / property loan by providing security to the bank towards repayment of the same.

It would be advisable for you to file appropriate proceedings seeking divorce as well as alimony and maintenance both for yourself and the son before the Family Court in the jurisdiction where you presently reside.
