Q: nuisance due to open construction activity by neighbour on the street
Hello, I wanted to ask, what legal remedy should I seek from a neighbour doing open construction work on the streets. Entire cement, rodi, sariya, steel rods are kept open on the streets which has blocked the colony road and parking area.
Advocate Kunal Kumar answered
You may file a civil suit for the damages being caused to you with an injunction suit to stop them from the nuisance immediately. It will be of civil nature and will be filed in the district court of Delhi. Before that I would suggest that you file a complaint in the Police Station. Please contact.
Q: What action can a bank take if a card debtor moves to another country
I have unpaid credit card debt when I was working abroad. I am in India since 2015 & I am currently not in a position to repay. Collection Agencies are threatening me with a legal case. What is my legal stand?

They can file a legal case against you. However, I would suggest that you may contact the Bank and enter a settlement agreement instead. That would be suggestive. It would be better if you let a lawyer speak on your behalf. Please contact.

Q: What are my rights on my fathers property when we are living seperatel
I am staying at XYZ . I am staying in First Floor which was built by my father in year 1987. The Whole property was purchased by my grandfather in the year 1974. The property still exists in the name of my deceased grandfather. My parents were seperated in year 2000. My father abandoned us in September,2003 and decided to live seperately and since then is staying at A with his illegitimate family. My mother is staying in B since 2001. My sister got married in November,2015. Since then my father twice threatened me to look seperate house for myself to which I opposed. My questions are as follows :- 1. Can my father debarr me from my stake/rights over XYZ??? 2. Can my father's illegal children move in to XYZ, do they have share/stake at XYZ??? 3. Can my father deny from giving property share/stake to me and my mother, sister ??? 4. Is there a way to stop him as till now he is staying at A ?
Advocate Kunal Kumar answered
Please update me if there was any will executed by your grandfather? If the property still exists in the name of your deceased grandfather, you may certainly have a right being it as a ancestral property. Your fathers illegitimate children can also have a right towards the property. Since it is an ancestral property, your father MAY not be able to deny yours/mothers/sister stake. You may file a civil suit. Please contact.
Q: How to file divorce seeking custody of daughter
My niece who is a Hindu is married also to a Hindu and is facing problems with her husband. They are having a 3 year old daughter Her husband has made video of her activities after agitating her and now is blackmailing her. He is threatening to go to court against her and take position of their daughter. He had also physically assaulted her after an argument following which my niece had called the police. As a revenge her husband is doing all these. What legal action can my niece take and how can she file a divorce seeking custody of daughter and seek alimony.
Advocate Kunal Kumar answered
Is there any reports or any kind of evidence to support that she has been physically assaulted? You may always file a case against him for physical assault. The position for the child custody depends. Mostly mothers are given the custody for which she is also entitled to child support maintenance as well as her alimony. Please be noted that the situation may change as per the facts which can be elaborated more clearly.
