Q: Can I claim my right on house built by me on someone else's property

me and my husband have plan to build up rooms separately for us but this property is in my mother in law's name and my husband have one elder sister who have rights in property. To build it I'm planning to sell my property in my native. It will be a profit for me separately or tomorrow will it create any problem.

Advocate Kaviyanathan D answered
Sorry , you couldnt able to do the same after building the same. The superstructure will be owned by the person who is the original owner of the property .. Further if there is no other option, then you can go for a sale deed of the superstructure alone after construction of the same.

Q: Government job benefit in inter caste marriage

Hi, This is X(Christian) and I belong to the Anglo indian community. I got married to a girl who is a Hindu belonging to the SC community. We tried applying for government job through Tahsildar office, which is a benefit under the inter caste marriage act, and our application was rejected by the RI. She stated that Anglo indian community doesn't qualify for inter caste marriage benifit. Our marriage took place at the Register office under inter caste marriage act. Kindly do clarify me on this and what would be the further steps that needs to be taken. Thanks

Advocate Kaviyanathan D answered
The benefits are extended to a person who comes under the community register of the Tahsildhar and if you couldnt able to provide a Community which is denotified by them, then the same will not be accepted by them ..! But if you have a community certificate issued in your favour, you can file a Writ petition challenging the said order of the Tahsildhar and seek for a Inter caste marriage benefit.
