I am christian and my boy friend is Hindu Brahmin. We have 7 years age different.I am 7 years elder than my boy friend. We would like to get marry. My family is ok for Register Marriage but My Boy friend side, not ok for inter religion marriage. Can u please help me to know about the Register Marriage procedure. Is there any problem in Age difference?

Advocate K S Rajeshkumar answered
You have two options in respect of inter-religious marriage, either1. You can register your marriage under the Special Marriage Act, 1954.2. Or you can register your marriage under Christian Marriage Act, 1872 where it is allowed to register inter-religious marriage. Generally, Age differences between groom and bride is not an issue at all. But there's a minimum age of marriage (i.e. Boy 21 and Girl 18 fyi)

Q: Can opponent file appeal after a permanent injunction

Hi i have filed a property suit in court.I'm 1st plaintiff. Judjment has been granted permanent injunction against defendant & announced as decreed with cost. My questions 1)Can opponent file appeal after permanent injunction? 2)How much cost should opponent pay? 3)If he makes an appeal how long it will take for second judgement coz this case has been prolonged for almost 15 years. 4) how much should he pay to appeal in higher court? 5)can we now collect all the original documents tat we have produced in court if he makes an appeal? Thank you for your response in advance

Advocate K S Rajeshkumar answered
1. Yes, He can file appeal. 2. Details of cost imposed be specifically mentioned in your order copy. 3. It depends, no advocate can be sure about duration or determine period of conducting a case. I hope that it'll take atleast 1 or 2 years.4. Merely because an appeal is filed, does not mean that the order or decree of lower court is stayed.

Q: Claim to property after the death of father

My uncle has been living in part of land on which we have two seperate houses, but it is under my grandfatjers name, so we pay alternate tax each year now, he's not good to us, has fought a lot with my family and has caused a lot of trouble to us. I believe my father built the entire house with his own money as he was the most educated and had a decent job abroad. My father passed away few years back and this uncle's wife came to us and asked for my father's death certificate which I refused to give, as I suspect they want to cheat us of our land, so now I'm thinking to drive them away from the land for good, but we don't own the land yet, it is still government land , we have yet to purchase it. My father has however left a power of attorney document giving my mother the rights , in the document it is clearly stated that my father is owner of the entire home and that he resides in part of it. I want to file a case against my uncle, what are steps I need to take?

Advocate K S Rajeshkumar answered
1. you didn't say clearly about the type of land i.e Poramboke, or Natham etc., Also you should have stated how long you been there. 2. First you have to get patta of the land for the whole extent. In case of Natham land you can apply for a Natham Patta with the documents you possess or otherwise you need to get the ownership of the land by the way of adverse possession.

Q: I want to live with my abusive husband but he is asking for divorce

I'm a Hindu. My husband was not affectionate towards me. So to drag his attention I texted some close texts to my friend. Now he is having those messages as evidence. I want to live with him. I'm having two small daughters. I'm working for very less paid salary. Financially I'm very weak in condition now with my daughters. I want to file maintenance, domestic violence and conjugal rights. Please help me. Actually he tortured me physically and mentally many times in this 8 years of marriage life.

Advocate K S Rajeshkumar answered
If you really intend to or want to live your husband don't file any criminal complaint against your husband. Try to explain yourself with husband either by you or by a person whom you both respect and trust which is the best way to convey your feelings. If you file any complaint against your husband, definitely it will increase the gap between you and your husband. You did a wrong either knowingly or unknowingly, try to convince him by the way you know. Consider the options you mentioned above at the last one.
