Q: Regarding incomplete chargesheet

Can chargesheet be filed in ndps act without the statements of accused??nThere is nothing in the chargesheet except the arrest warrant not even named in FIR? What should i do?

Advocate Jwalant Vora answered
If the chargesheet is not yet filed You should go for the quashing of fir at the high court so that the fir if incomplete shall be quashed and set aside. You have very good chance of getting it quashed as there is not even you name in the Fir. Also if the chargesheet is incomplete you can still go to the high court for quashing of the whole proceedings. This way the case itself will be quashed and set aside.



Q: have question about chargesheet fileing and other process in my case

Hi Sir and Mami m accused for financial fraud, i arrest under IPC 408 and IPC 114, so i m on bail period, but problem is police still not file a charge sheet into a court, and after charge sheet what we will do so court listen to us and given right justice to us.

If chargesheet is yet not filed, try for quashing of FIR at high court under section 482. You Shall not be able to do it after chargesheet. Once the chargesheet is filed after that fair trial will take place you will need a proper advocate so that u can get proper justice, do not worry you will get full chance to represent yourself and you will surely be heard by the court.



Q: Jurisdiction issue between 2 police stations for filing FIR

We had filed a written complaint but 2 police stations are saying that the jurisdiction lies with the other and they are not filing an FIR since 3 months. What to do in such a situation. We talked with both zone dcp and they too are saying that jurisdiction lies with the other station.

Since,You are having a Jurisdiction issue and FIR. Is Not being filed, in such a case you should approach the High court filing a Writ petition to solve your problem. This way you can get the clear idea of jurisdiction as well as ,the FIR will also be filed by the direction of the High Court
