Q: Suicide Case - Suicide note contain the details of a person
Hi My friend's mother gave 1.25L to one lady 4 years back. yesterday Friend's mother and Sister went to the defaulter's home to collect the debt. They asked harshly to collect the debts from the defaulter. After they came back, after 1hr she committed suicide and wrote My Friend's mother and sister's names in the suicide note. Now what is the legal remedy for us? Whether they will take remand of our people.
Advocate Jhansi Rani M answered
hello sir,Attempted suicide is a serious problem requiring mental health interventions, but it continues to be treated as a criminal offence under the section 309 of Indian Penal Code. If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.at the same time Suicide attempt can be defined as a non-fatal self-directed potentially injurious behavior with an intent to die.if any act done by the victim, the accused is not responsible for that .in this case your friends mother and sister's intention is not to make her die. Also you mentioned that the defaulter had attempted suicide, You haven't mentioned their current status. If the defaulter had since been deceased, the consequences will be severe. They went to recover their money.mens rea(the intention)s is very important. prove your innocence or guilty of offence .You can consult a experienced criminal lawyer. If they are scared of arrest and remand they can take an anticipatory bail. This is your legal remedy
Q: Tenant not vacating since last two years and irregular in paying rent.
I own a flat in Uppal, Hyderabad, which I have rented to an advocate back in 2018-2019. He is extremely irregular with rent payment. So far my efforts to vacate him were unsuccessful. At present, he owes me rent for the last three months and whenever I inquire about the rent or the expected date of his departure, he threatens to file a defamation suit. I live in USA and don't have any reliable contacts to help. please advise or steps you would take to evict him and your associated charges .
Advocate Jhansi Rani M answered
Hello Sir,I noticed that you didn’t mention if the agreement between you both is either rental or leave and license. Do you have validity for the agreement? Is so, you can proceed to the concerned court to file an eviction suit . There is no difference between a common man and an Advocate: Law is above the all. You may consult any good civil lawyer as you have every right to evict him from your property.
Q: Reg house owned by my father how to stop registration
We have a house and its self owned by my father. It's not a inherited property. My mother has expired in 2011. My father is very negative person and who ever takes care of him (I as elder son took care of him after my mother's death) he treats them very badly, he did it with my mother and now me and my wife and kids are bearing the brunt. Taking advantagof this situation my younger brother and sister are trying to get property registered on their name without my notice, can I legally stop this?
