Q: Divorce by mutual consent within one year of marriage
I have been married for 10 months..it was an arranged Hindu marriage and due to severe incompatibility issues we have decided to separate by mutual consent..do we have to wait for a year before we can file for a divorce? there is provision in the law in which the divorce can be taken before 1 year . it totally depends upon the fact of the cases you have to satisfy the Court marriage has been irretrievable breakdown .
Q: In regard to distress warrant Issue
Husband was not able to pay the maintenance for last 5 months as he is unemployed for 1year and his wife legally was to return back to the in laws but she didn't do so ....please take into consideration unemployed. What should be done by husband to be saved from this warrant????? Kindly reply

there many Grounds available to the husband it depends upon the husband which ground he wants to take weather the maintenance has been asked under 125 CrPC or any other provision of law it is not clear in this question
