Q: Regarding PhD through a off campus study centre

I started pursuing Ph D from Directorate of Distance Education, Dravidian University in 2008-09. I submitted my Ph D Thesis in july 2014, and paid all the dues and fee of university and study centre (off campus study centre). But till date the study centre owner has not met the university requirement of Ph D guide verification. I have requested him several times and now he is not picking up my phone since last three months. Kindly advice how to deal with him as guide is his relative and donot interact with me after the submission of the thesis.

Off campus studies are regulated by the UGC and IGNOU. If the institution has obtained necessary permission for off campus studies then only it is possible to conduct any off campus course. Besides, other preconditions for PhD are also to be followed.



Q: Internet service provider sending fake bill. Connection already cut

 I had taken internet connection way back in 2012 till last year Sep-2016.I was using their services and paying them regularly. Their billing cycle start from 8th to 7th of next month In the month of Sep -2016. I have used their services for only few day after that I stop using their services till now since I have used their internet services for few days in Sep so I had paid them Rs;-211 in the month of Oct-2016 after that I had never used their services till date because I have switch to a different service provider for my internet usage. Issue:- From Oct 2016 till now they are sending me the full bill amount which is Rs:862 however in the month of Jan -2017 they have send me a bill amount of Rs;- 725.85. When I m not using their services for more than 4 month then why they are sending the bill for the whole month

It depends upon the nature of contract between the consumer and the service provider. If you have given notice to the service provider about your porting to the other one then the contract ends. If the previous service provider charges despite the fact that you are not using in that event you can make a complaint to TRAI or to consumer fora.



Q: Clarification regarding appeal in supreme court

A judgement service related has been rejected by high court of guwahati on 2005. Can I make appeal before supreme court?

Against a judgment of High Court Appeal lies if leave is granted.In case no leave has sought I'm the High Court Special Leave to Appeal can be filed.There is limitation of 90 days in filing such Special Leave Petition.If you can show and prove that the delay is beyond your control you can file now.



Q: How to convert proprietorship firm into a pvt. ltd. company?

We are planning to convert our proprietorship firm to pvt. ltd. company, in which the proprietor will hold more than 90% shares. But we are uncertain whether we can use our existing credentials like work orders for bidding after conversion? If yes, what can we do if the client denies to except the past experience?

To convert the proprietary to Pvt Ltd company it needs to incorporate such a new company for the sale of business. The newly Incorporated Pvt Ltd company must one of the objectives to take over. Then it can take over the proprietary concern.It has different stages to get conversion



Q: How to get refund of the amount paid for booking a commercial property

Filed a case at district consumer forum against the developer but the same was dismissed in Nov 2015 saying commercial properties can't be treated as residential and hence no refund...is there any scope? My lawyer never told me this during the case...

If the purpose is commercial one a suit for recovery would lie against the developer.The other remedy is to challenge the order of the district's forum in the state consumer disputes redressal commission by filing appeal showing the transaction not commercial one but for livelihood.
