You must try to talk the issue out with the lawyer first. Maybe there is a communication gap. Incase he feels that he is unable to give time to the matter and you want to shift, you may take a non objection from the existing advocate and engage some other counsel.



Q: Will neighbor be liable for the damages cause to the property by him

Second floor bathroom leakage problem to first floor owner . IN repair by second floor owner then cost of repair bear by first floor owner by fifty percent or not . Cost of repair only bear by second floor owner ??

There is no as such formula to measure quantum of damages payable to your neighbour in case of damage of property. The neighbour will have to prove that the damage caused by leakage from your property was the sole reason and further, what is the amount has he has spent to get the same repaired.



Q: How to get the details about the ownership of land

My neighbors have built a house on a land where earlier an old ancient muslim gumbad (monument was built) this land was encroached by someone after demolition of that monument and sold to our neighbours.This place is adjacent to my house.Can we take action against them and get their house demolished? how can we find about the details of the land that initially it had a monument and belonged to muslim people.

First and the foremost, we'll have to see who is the owner of the land. For that, either we'll have to file a RTI with the concerned department or we'll have to Due Diligence with the Sub-Registrar office because it is necessary to find out who is the actual owner of this property. As you said, there was a Muslim Gumbad which has been demolished by the authorities, there are great chances that Government or any of its authority is the rightful owner of the said property. In that case, we can get them evacuated from the property easily.
