Q: Sister in law asking money to give divorce putting false aligations

My brother he got married in 2016 April. He is working in US currently at the time of marriage also he was in US. His wife got H4 in November 2016. He applied for extension mean time his brother marriage was fixed for Feb 2017 so he planned that he will take his wife after attending his brother marraige. Due to personal issues it postponed to April 2017. he took her in April 2017 to US from 3rd day she started saying she wants to go back to India and told to his parents and his neighbors that he is not a guy . she threatened him and Said she will kill him. She was not talking to him properly finally after 15 days she came back to India saying she will give divorce. Mean After coming to India she went to police and she said she want 30 lakhs finally now they are asking 10 lakhs. She is not ready to come to stay with us can we apply for divorce now. If we apply how much time ot will take. They are saying they need money then only they will apply for divorce. What should we do?

You can file divorce petition against her. And it will take on the court pendent of cases. If you both agree for divorce it will take 3 months for obtaining divorce. And regarding amount they demanding is illegal. You are not liable for pay any such amounts

Sir, I have got married on 03.05.3017 in certified Hindu temple and the same was not registered with registration office.both are employees in postal Dept.One month before she went away from me due to past relation with some other guy and staying outside.she told that he is block mailing her with recorded proofs.we want to get divorce .Kindly suggest the procedure

You can file diverse petition for illegal intimacy with others. And for that you have to prove your wife is extra marital relationship with the boy. For that you can file a police case u/S 497,498 IPC

You can file restitution of conjugal duties in a family court. And in domestic voilance act your wife can claim gold ornaments presented her parents at the time of marriage.. She has to prove that the gold ornaments with you. And dowry amount there is no relief to her



Q: temp injuction order refused by opposite and made them as exparty

Sir, namaste, i want to explain in brief the facts of the case. i filed case against function hall where they have been disturbing others by playing songs in high volume and causing disturbance to restrain the illegal running of the function hall (constructed without getting municipal permission) i filed a case and got temporary injunction order to stop running function hall . The court persons tried to served the orders to the concerned persons, but they refuse to take the injunction orders and refused it, court in turn made them as ex party. Now they are still running the function hall as usual. Next hearing date is posted for 15 days. My question is whether can I approach police to implement court injunction order after submitting certified copies of the temporary injunction from the court? Or should I wait for the next hearing of the court.

You have to get the temporary injuction order absolute and after getting the order copy you can file police protection petition for the same. And you can also file disobedience of court order with the sane



Q: Procedure for claiming registration of bowell-fencing from brother

My father having 8 acers of land and he died on 2008 sep and after that that land was transfered to my mothers name. After my fathers death 6 Lakhs loan was there, and my elder brother was not ready to pay the amount at that time so i taken responsibility and cleared the loan and spent some more money on the agriculture land and later after 8 years my brother came and asked my mother that he want half of the land on his name, imeediately i said i invested lot of money on this field please give half of the money to me then he agreed on that.When i went out side of INDIA for some work then he immeidiately did registration of land and occupied my borewells land fnecings etc... and now he was saying that i dont want to give singe rupee to you...do what ever you want.... So please guide me how to proceed further...

It is joint family property so your brother have equal right in the said property and he is not liable for any loans you cleared off. As you have not obtained any documents regarding the loan liability
