Questions Answered by Advocate Dinesh Singh

Q: Do daughters have a right ancestral property of Great Grand Father

what is my and my mother gets from my great grand fathers property ?

Advocate Dinesh Singh answered
According to SC judgement daughter right to ancestral property dose not arise if father died before the amendment of Hindu Law came into force in 2005the father would have to be alive on september 9,2005 , if the daughter were to became a co - sharer with her male sibling. The amendment to the Hindu Succession Act giving daughters equal rights to ancestral property is applicable even for girls born before the law was changed in 2005, Since your father died in 2011 you would have share in ancestral property. Your mother cannot gift away your share. The amendment to the Hindu Succession Act giving daughters equal rights to ancestral property is applicable even for girls born before the law was changed in 2005

Q: Clarification on sale of land bought through GPA

Sir,if some one bought land before 2009 through GPA and want to sell land now in 2017and owner died now ,if he can do this? This is question, someone asked me and I want to answer him, what will happen in this case

Advocate Dinesh Singh answered
That the immovable property can be legally and lawfully transferred/conveyed only by a registered deed of conveyance, Transactions of the nature of GPA sale or agreement to sell or will transfers do not convey title and do not amount to transfer nor can they be recognized or valid mode of transfer of immovable property. The legal position of that agreement to sell/GPA/will transactions are not transfers or sales and that such transactions cannot be treated as completed transfers or conveyances. But they can still be treated as existing agreement of sale, Nothing prevents affected parties from getting registered deeds of conveyance to complete their title.

Advocate Dinesh Singh answered
You need to register FIR,Blackmailing amounts to Criminal intimidation, which is well defined in the Indian Penal Code Section 503 as,Whoever threatens another with any injury to his person, reputation or property, or to the person or reputation of any one in whom that person is interested, with intent to cause alarm to that person, or to cause that person to any act which he is not legally bound to do, or omit to do any act which that person is legally entitled to do, as the means of avoiding the execution of such threat, commits criminal intimidation. The offence of Criminal intimidation can be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. I cant advice you much without knowing the fact . you can surely turn the table around
