Q: Ancestral property partition post my grand father's death.

Hi,My grand parents have 4 children (two uncles,my mother and my aunt). Post my grand father expiration in the year 2015(he left no will),my 2 uncles have registered agricultural land properties in joint with my grand mother. I'm doubting that they have removed my mother's and my aunt's name from the family tree to avoid division among four and my uncles still get to enjoy all the land outputs .What's our next step to get our partition from them?Few suggested that we can approach assistant commissioner of the local area and write a request letter to stop transactions on those lands and to add my mother's and aunt's name in it. Will it help to get the partitioned land registered in my mother's name? What are the next steps? Thanks in advance.

Advocate Dilip M. R. answered
Hello sir,Approaching the assistant commissioner would be a futile effort as he is the competent authority to only direct the concerned tahsildar to include your mother/aunt's names in the RTC. However he has no authority to direct your uncles to provide your mother's and aunt's share from the proceeds. I would advice your mother/aunt to file a partition suit before the jurisdictional court claiming their share in the same. In the said case, your mother/aunt can also claim their share of the proceeds. For any legal assistance in this regard feel free to contact me.Regards
