Q: What is the process to file an appeal in state consumer forum

Sir, kindly confirm whether I have to re-submit all the copies of complaint, replies by OP , evidences and written arguments along with the memorandum of appeal to state commission? or will the state commission call the file from the district forum based on the memorandum of appeal? As am aware, I have to submit memorandum of appeal along with the orders of District forum. Please confirm.

You need not to re-submit all the copies of complaint, replies by OP , evidences and written arguments along with the memorandum of appeal to state commission. Q: Bought a TV from snapdeal showing defects and not replacing it

I Purchased Micromax LED TV in Feb 2016 from Snap deal and since then I am facing problem. Every time it goes to repair center comes after 4/5 days and it remains ok for couple of days and again spot comes. Every time i ask for Replacement they just say its dust and they cannot give replacement .

If you have documentary evidence what you said, you can file a complaint with District Consumer Dispute Redressal Forum after taking the help of local lawyer. You have a good case and get replacement.



Q: Filed suit for recovery party not coming for hearing what can i do

I had given loan of Rs.5.60 lakhs. 12 self-drawn cheques were issued by the accused out of which 8 have been encashed for total amount of Rs.1.57 lakhs. 9th cheque for Rs.2.0 lakh has been bounced. I have filed summary suit for receovery of 4.03 lakhs with interest and other cheque bouncing case for 2.0 lakhs u/s 138. The accused has not replied against recovery suit. The date of case u/s 138 is coming. What should be our action. Shall I go for case under section 420 against the accused.

From the given facts, I understand that in recovery suit defendant has been served but he is not filing the reply. In summary suit defendant has to file leave to defend within 10 days. In case he fails, the Judge will issue summon for judgement. Your advocate will advise you in this regard. In 138 case, the accused will come and submit bail. In case, the accused is interested to settle the matter, take it to mediation and settle the whole case. Otherwise, contest 138 case for Rs.2.00 lakh and summary suit for recovery of Rs.4.03 lakh, you will get decree from trial court. Why don't you ask your lawyer.



Q: Can legal notice be sent through email

I have received an email from Manoj Som on behalf of reliance communication. This email says Legal notice for recovery and it's asking me to pay 2971 as immediate amount with 2.5% interest for some broadband connection I was using 6 years ago, I don't even remember if I paid the amount on disconnection or not. Can a lawyer send a legal notice via email?

A broadband connection used by you 6 years ago and demand by reliance now after 6 years is time bound. Hence, keep silent and do not respond. In case they initiate any legal proceedings (which they cannot) you have right to contest there and then. Till then cheers.



Q: Credit card defaulting and its effects on civil service job

Hi sir.. kindly suggest can I b prisoned for defaulting my credit card in 2013..?? Or Can I not be considered for civil service job ??
