Q: Regarding a doubt in apprehension and remand time period of CCL

The CCL boy was apprehended at 11:00 am in a pocso act case, after completing the remand procedure formalities, due to late hours the CCL boy was kept in Juvenile home for night custody. The next day police taken the CCL from the juvenile home and produced before magistrate at 13:00 hrs which exceeds the 24hrs grace period in police custody. Is this fine ?

No, this is not fine. The production after 26 hours violates the 24 hour rule. Unless there’s a recorded and justifiable reason, it’s a procedural irregularity and can be used as a ground for challenge especially in a bail or quash petition.



Q: Illegal trespass and double LRS

Iam senior citizen, purchased plot in Hyderabad in1990 and got ULC clearance and also (LRS) 15 years ago. A person attempted trespass in 2018 by fraud documents with different plot number and survey number to mine and FIR done on him . His people laid huts in my plot, police refused to take complaint saying it is civil case. His plot also LRS in 2017 by GHMC and i complaint to GHMC ,but no action. If i file mandamus writ against GHMC and will highcourt give eviction order the trespassers

Q: Income Certificate issuance without verification

Income Certificate has given wrongly with out any enquiry as wife is working in govt sector and husband is an famer holding 10 acr land and earning around 10 lks per annum but income certificate is taken for only 1.40 lakh per annum and their kida got free seat under BPL reservation. How to lodge complain among those people. What action can be taken

Q: Fraud by borrower in case of Guarantee

I have signed a guarantee for personal loan for a childhood friend in a private chit fund company as he claimed that he too was a govt servant. However later I got to know that the friend has been impersonating govt official and he has absconded the state. All the documents he submitted for loan are fake and other guarantees are fake except me. Now the chit fund company is after me. Kindly advise how to get out of the guarantee bond.

Q: Surname is different in Aadhar and Academic certificates

Hello. My daughter's name in aadhar card is Gaddam Sai Sri Vanshika. but in 10th and 12 th certificates it is mentioned as G.Sai Sri Vanshika. we want to apply for passport for her now. Will there be any problem. Also please advise if we have to get the name changed on both the academic certificates. if so how to do that. Please help

to apply passport there won't be any issue, but later while study in abroad or while getting any job, there will be a little issue like you will have to file affidavit everytime when it requires. The best thing is you change the name in the aadhar card as per the certificates is very easy .
