It is wise to appear before the high court after the charge sheet as most of the applications before the CS get dismissed reason being still in the primitive stage after the charge sheet you have an upper hand the case is mean made up only to harass you and your parents it is always wise to file for quashing before High Court after the charge sheet is made.

Q: Maintenance case against my husband

Husband has filed section 9 RCR to call me back whereas I have left him due to mental disturbance given by him in marriage like not Taking care of basic needs and asking the money back which he paid me when I asked for my need.He didn't arrange practically anything for my pregnancy delivery but verbally he said his family will help but his family saying call your mother to help you.So,these many politics happening and effecting my daily activities mentally.Unfortunately,we have 5 months old son .1 year of arranged marriage.Iam also working but less salary.So,n1) i want money back which my parents gave at the time of marriage.2 ) I want to set my son's future which is impossible alone with my salary.3) i don't want to be with him at all.

if he is not paying the maintenance file in execution petition before the same Court which has order the maintenance file the petition with the dues which are outstanding which he is supposed to pay

consult your advocate if you have already one there are lot of Supreme Court citations which states when the parties have been made in the domestic violence case who are not staying with the couples from day one and only for the sake of making them as a party they should not suffer during the entire trial and prove all means that they are staying in a different place and not staying together

Q: Children Custody and permission to meet

My husband and me are away since 2 months due to clashes and I am staying in my mom place. next month I have plan to shift Bangalore and stay separately with my 2 kids. My husband is telling indirectly weekly 2 days he will keep kids and 5 days with me. neither he nor me sent any notices to each other and I dont even want to send. the only thing I want is he should realize his mistakes. I dont want to leave children even for 2 days until our problem resolves . Can I say no I cannot give children for 2 days also?. What if he bring legal notice from court to give kids? nissue between me and husband is he is irresponsible, drinks a lot, ask my bank statements , he dont let me to help my parents family who is running through financial crisis , he always abuse me and my parents family including brother , he is more possessive about his mother, directly he tells even his mom is wrong I have to keep quite, he forces me to quit job and become housewife

children are below 7 years you as a mother have all the rights to keep both the children no need to worry sort out the differences among you instead of dodging at Court doors both of you resolve at the earliest gaps are dangerous and don't let it go out of proportion
