Q: Trasfer of flat to mother when father pass away

My father pass away in flat namination form two name my and mother 80/20℅ if I want to transfer flat to my mother is release deed of my self needed or only notery NOC will be enough?

release deed is require for transfering the shares of your to your mother . then only the mom can become 100 percent owner of the said property .so first make release deed and get it registered notary will not do

Owner deceased is survived by his sons & daughters.He has left his will which is notarized.

submit the will to the respected authorities who will transfer the name and if they ask probate for will then you have to move to the court to get the probate done and then submit the probate copy and then only names would be transfered

Q: Sale of Property,whether NoC is requried for each legal heir

Want to sell a flat, it belongs to my father, not sure mother is the sole nominee or not. He is no more with us and my sister lives abroad. Do we need any approval and signature from sister for selling the property. If yes, what documentation we should get signed from her so that we can proceed with the sale without her presence too.

release deed is the document you need in which you and your sister will release their shares to your mother so that she can gain 100 percent shares of the flat and can become sole owner of the flat and sister sign is required but if she stays abroard then power of attorney is needed to sign the document on her behalf
