Questions Answered by Advocate Anurag Kumar Singh (25+ answers)

Q: Husband in live in relationship

Husband live with another girl and also also admitted same in a statement before police...can it amount to bigamy?

Advocate Anurag Kumar Singh answered
No, the present circumstances shall not amount to the offence of bigamy. It is pertinent to note that if a legally wedded husband engages in a live-in relationship with another woman without entering into a lawful marriage, such conduct may constitute an act of adultery within the meaning of matrimonial laws, thereby furnishing sufficient grounds for the aggrieved spouse to seek dissolution of marriage. Under Section 13(1)(i) of the Hindu Marriage Act, 1955, voluntary sexual intercourse by either spouse with any person other than their spouse is a valid ground for divorce. However, it is further clarified that as per the judgment of the Hon’ble Supreme Court in Joseph Shine v. Union of India (2018), adultery is no longer a criminal offence under Section 497 of the Indian Penal Code, but continues to remain a civil wrong and a recognized ground for divorce or judicial separation in matrimonial proceedings.

Yh Mar pit Kai bar hui h mjh ab sath ni rhna mjh alemini bh chahy m kya kru wo bolte h tu kuch bh kr mera kuch bh begad ni sqta

Advocate Anurag Kumar Singh answered
Madam, it is respectfully submitted that the Hon’ble Court exercises strict scrutiny in matters pertaining to offences against women, as several statutory provisions and judicial precedents exist to safeguard their rights and interests. However, it is imperative that the due process of law is duly completed before any relief or adjudication is granted.
