Questions Answered by Advocate Anubhav Tyagi

Q: What does being prosecuted mean

A complaint(not an FIR) case was registered against me. The magistrate issued summon order. I got bail. The complainant and witness later rescinded their statement. I was aquited. No chargesheet was filed against me. Now i have to fill in a attestation form "have you ever been prosecuted". Should i fill yes or no?

Advocate Anubhav Tyagi answered
Prosecuted basically means that you have been a part of any adjudication, in my view you should write yes, because it will affect you adversely, if you write no and it is discovered during the police varification, chose wisely.!

Q: Can builder demand for VAT after registration of conveyance deed

Whether a builder in Haryana is justified in making demand for VAT @ 1% of sale price of flat in year 2018, when construction of flat was completed between year 2008 to year 2012 and all payments towards sale price were made from year 2008 to year 2013 and registration of conveyance deed and possession of flat was completed in September 2013?

Advocate Anubhav Tyagi answered
If the sale was made in the year 2018 then only GST has to be charged. The payment which took place at the time of registration will decide whether VAT can be charged or not, if the registration was done before1st july 2017 then only VAT can be charged otherwise the builder cannot ask for VAT
