Q: Cheque Bouncing case,Want to know if the cheque bounce and its remedie

I was a director in one company and resigned before 3 years.I filled dir11 and dir 12 was not filled by the company.After 3 years resignation i came to know before 3 years some cheques issued by other director and presented after 3 years of my resignation and got bounced.what is my personal liability

you have no personal liability as it is the cheque given by the company and you are not a signatory to the cheque also. further you wont be involved in the transaction in which the cheque is given as well. supreme court has time and again held that directors who are not signatory to cheques or not involved in the transaction cannot be made parties in a cheque bounce case

I have filled a cheque bounce case against a accused,the accused once came and have taken bail,now he has closed his shop(i had only shop address)& have gone abroad for work ,how to get him attend the court?

yeah so when you saying that has gone abroad you need to find out where is on which address in a because without knowing the address we cannot execute any Court cannot execute any warrant where is restriction it commander all the information to the magistrate court and there will be issuing the warrants



Q: Cheque bounce in loan recovery

I gave loan to my brother's wife for her higher studies and to set up 2 dental clinics around 40lacs as my brother was not earning well but now after 10 yrs of marriage they got divorced mutually without claiming any maintenance/moveable/immovable assets from each other. To be on safer I asked her to sign a loan agreement and give post dated checks to recover my loan from her which she did and agreed to pay. However this loan agreement was not mentioned in divorce petition as the lawyer said its better to not mention in divorce petition. Now when I am presenting the checks they are getting bounced and when I asked her she is refusing to pay saying that they were taken forcefully. Can I file 138NI ? Will she escape without paying as she is a female? Will court look at it as family issue and release her from this legal debt?Please advise.

her being a female or being a family member will not matter. if there is debt, 138 NI will attract. as simple as that. but you should send notice within 15 days of cheque bounce and file the case within 1 month thereafter. follow the timeline strictly



Q: My uncle is no more and his loan is closed too.but case is running st

My uncle had a personal loan in idfc first bank. He expired on 2018. Bank has filed cheque bounce case against him on 2019. But insurance got claimed and the loan amount is settled and closed on 2020. But the case is running still in the court ,They sent a summons to home. Now what to do? How to make court understand that my uncle is no more nad loan is closed too. Should i go through a lawyer or i can go directly to court and answer .

you can go directly and answer but it is advisable to have a lawyer as they would understand the legal issues and avoid the loan liability if any to fall on you . if you are confident that there is no liability, get a no dues certificate from the bank and present it in the court on the date of hearing

I had taken education loan in PSU on 2011. I couldn't repay EMI's on time due to unemployment.I have settled the entire pending amount and took clearance certificate on November 2020. But on 04 March 2022, i have received notice from civil district judge to appear for lok Adalat. Is this right?

you can appear and appraise them that you have made the payment and give them a copy of clearance certificatethis happens because the bank would have started the legal process before you paid the entire emi and closed the loan
