Q: How to establish if a property is Benami

Sir, The director with zero income of a Judgment debtor company which has stopped operations of the company after siphoning funds from the company, has bought a house in his wives name , the wife has no known source of income in affidavit in high court has claimed house was bought from funds from relatives and friends . as both the husband and wife don't have known declared source of income to buy a house . Is the house benami ? will the house be considered benami property? pls advise Regards

Section 4 (9) of the Act no.43 of 2016 says- Benami transaction means-Any transaction or arrangement where a property is transferred to or held by a person and the consideration of such property has been has been provided or paid by another person.It has some exceptions too.But apparently in this case, it seems to be a benami transaction.



Q: tenant refusing to pay water bill

my tenant deny to pay water bill, but the same is mentioned in rent agreement , and start threatening me.

If it is specifically mentioned in your agreement of tenancy then the tenant has to pay the respective charges which are agreed upon in the agreement.You also mentioned that he is threatening you so please elaborately explain the nature of threat and other relevant issues pertaining to this matter.

I would suggest you to give a 15 Days legal notice to the institute and narrate your grievance with the time of it's occurrence and mention the remedy you seek from them and also keep a copy of the same and also of other correspondence if any.Sent it through RPAD.If they do not respond then you go ahead with a complaint u/s 12 of the consumer protection act.As regards to the proof of deficiency I can only say something if I get to know the whole issue.
