Q: Mother left her kids saying she is going to die
A woman left her home leaving her husband and one son and one daughter behind saying she is going to die as she is fed up with her life.After almost 20 yrs its been discovered that the woman is alive and living lavish life with another man under a different name . Her first husband is dead ,her kids are grown up but had a terrible childhood and had to face harsh difficulty in everything.Now its been almost 35 years .The person she is living with as spouse is her own nephew.

The first thing to check is when the first husband died, because the answer depends on it. If the woman remarried while he was still alive, that marriage is void under Section 5(i) and Section 11 of the Hindu Marriage Act, and she can be prosecuted for bigamy under Section 82 BNS (earlier Section 494 IPC), which carries up to 7 years. If he had already died, bigamy won't apply.Even then, the second marriage is on shaky ground. An aunt and her nephew fall within the prohibited degrees under the Hindu Marriage Act, so the marriage is void unless there is a proven custom allowing it. Section 18 also provides a small penalty for it.If she lived under a false name or used fake documents, the police can look at cheating and forgery. Deserting the children can also be an offence (Section 93 BNS, earlier Section 317 IPC), but it covers children under 12 and is hard to prove after so many years.The children may also have inheritance rights. If she is alive, she could claim as a Class I heir to her late husband's property, so they should check how that property was handled.My suggestion is to collect proof of her identity and the timeline, then consult a local family or criminal lawyer about a complaint. Please don't take any action outside the law.
