I have filled a case u/s 138 of NIA. Should I have to file a suit for recovery too because case u/s 138 is to punish the accused and not to recover the dues.

You may file a summary suit under order 37 CPC for recovery of your amount in case there is a written contract between the parties. Else, a recovery suit may be filed. It is advised that you should take a detailed legal opinion based on the actual facts of your case.
Q: Query regarding filing of a case against builder
As Homebuyers are unsecured creditors. If we file a legal case and after that If another reputed builder become Insolvent Like Jaypee. Then Can we be secured creditors as we have filed a legal case.

Firstly, as per the Insolvency and Bankruptcy Code, homebuyers fall under the category of operational creditors. Secondly, if an insolvency proceeding is initiated against a corporate debtor i.e. the builder in your case, then a moratorium period is declared. Under this period no new case can be initiated against the corporate debtor and all the current pending cases are stayed.Thirdly, if you had paid any builder for a flat and now Insolvency proceedings have been initiated against that builder, in that case you will have to file your claim under FORM B of the insolvency Regulations within stipulated time period mentioned by the IRP (Insolvency Resolution Professional).(Legal assistant required for the process).
Q: I have defaulted in my personal loan. What are my legal options
I am unable to pay my HDFC BANK personal loan debts since last 1year and got notices from advocate and not presented in the court till now. The amount of loan is 5lakh and i paid only 18 emi's. At this point of time my loan outstanding is 4lakh 50thousand. I want to settle it as soon as possible in the least amount. Is it possible to get any letter from court or bank after settlement of loan so that my cibil score not get impacted so much and i can apply cards or loans in future. I need the full information of consequences and solutions which ever is possible. Please help.

The Bank has the right to move an appropriate application before the Ld. Debt Recovery Tribunal (DRT) for recovering the outstanding amount from you. Further, if you are not able to clear your outstanding amounts, in that case your CIBIL score will get affected. Firstly, contact the branch manager and try coming to a settlement on a mutual basis without letting the bank initiate legal proceedings against you before the Ld. DRT. Once the bank initiates legal proceedings against you before the Tribunal, the bank will have the right to recover the said amount by selling your assets.Secondly, since you have received notice on behalf of the bank through advocate, it is necessary for you to give your objections to the same (take legal advice). This will help you in case the bank initiates any legal proceedings against you.

Filing of Claim before IRP depends upon the type of claim you are seeking. Under the IBC Code there are 2 types of creditors: Financial and Operational, including workmen and employees. The IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016 specifies different types of forms for the said 2 categories and for workmen and employees. The documents required for filing the claim are mentioned in the said forms. You will have to seek a professional help for filing of your claims.
