Questions Answered by Advocate Aayush Chandra
Q: who are not eligible for government jobs ?
will call back-- free question posted *LAWYER-SEARCH* my name is involved in a fight .but compromise has taken place.but police has taken my signature on the page on which compromise ia written.does this means i have a police record.by this am i become ineligible for government jobs as police verification is required for all government jobs. who is not eligible for govt job? plzz tell
Advocate Aayush Chandra answered
Depends on the gravity and the nature of fight. From your query, I understand that no FIR has been registered and the complaint has been compromised at the initial stage and therefore it was not a major fight. This would not be a ground to disqualify you from a Government job as per a Division bench judgment of Delhi High Court. However if you apply for a government job, please do not make a false disclosure in the information column if they ask for such information. Rest you are fairly secured by a very progressive judgment of our High Court.
Q: how to recover outstanding payment
One of our clients has stopped paying us the dues, We have made several calls, visits but nothing is done about it. Now, i would like to know a couple of points. 1) Legally how can I sue them and Get the outstanding payments to Debited to my account? 2) On what grounds can i file a legal case against them? 2) How to deal with such clients? 3) What is the average time that such a case is resolved? 4) Will i be paid any compensation except the principal amount?
Advocate Aayush Chandra answered
There are two ways you can pursue the matter. But before that I hope you have proof of payment made to the client. Accordingly you can send a legal notice first demanding the amount. If the client still doesnt pay then you can file a suit for recovery. It will take a maximum of 15 months. You can get an interest of 12% p.a on the principal amount alongwith litigation costs.
