Q: Return of Stridhan to wife in CAW
My wife has filed a complaint of dowry and Dv in CAW and DV case in court in dec 2018. Dowry is absolutely false claim. She took away all her items except few jewelry in nov 2018. Now she has submitted an false and exaggerated stridhan list in CAW. However i am trying to reconcile my marriage. I haven't received the copy of CAW complaint yet while DV case summon is received. Also she has not made demand of stridhan before. In DV case also she has demanded return of Stridhan and cash. Please tell me how to return her real stridhan items which she left intentionally in order to avoid 406 as there was no intention to retain those items nor i came to know about her demand untill she submitted in caw cell. Please tell me whether i can be charged under 406 if complaint is fwd to PS, given that i have unintentionally kept lying her items in almirah and also i had no knowledge of her demand untill she provided me a list in CAW. pl guide what remedy i can take.

Hi, if the investigation has not been completed by Police, you will be called by the concerned Investigating OFficer for the statement in this case where your wife has filed this case. Further, you will definitely get notices for the respective hearings.

My family is forcing me for a marriage which I don't want to do. I talked to them about this but they are not listening to me. The have warned me if I go against their wish they would do whatever they want. Is there any legal way in this case?

The only way you can tackle this is by making them understand your situation. You dont want to involve Court or Police in family matters. However, you can report to Police or make a private complaint against them, which is not the advised route to go against them.
Q: Around8 years of relationship n now she is disconnecting me
I am in a relationship for around 8 years with my girlfriend/wife.she stayed at my home for 2years by telling my family that we married in a temple n yes we did by her choice after that for 2 yrs when she was in PG she was involved in every of my family function,for last 2 years she is not treating me well n now in nov 2018 she told me about a guy she was attracted towards him,she never talk to him,to prove that i ask her to prove it but she failed somewhere,now for 3 months we are fighting,on 10feb i ask her to get engage wt me she came to delhi for that,then bcz of her family they decieded to do it on 14feb,we had a fight on 12feb now from that day till now engagement is postponed to november but now she dont talk to me,dont meet me as she says i fight her,yes i fight her bcz she mostly disrespect me or talk about things which create problems,now what can i do legally against her as she is not willing to come to kolkata wt me,want to stay in delhi,my family repu is gone,i wnt to end

File an application for restitution of conjugal rights under the Hindu Marriage Act, if you are Hindu in the court where you both last resided as you both are legally married. I am assuming you are Hindu because you have mentioned that you both got married in a temple.
Q: Remedies for deficiency in service by the builder
Project is in ghaziabad. Flat 755 sq ft for Rs 18.85 lakhs (95% payment already done) Booked in 2012. Recently builder has sent letter of intimation of offer of possession but has not raised the final demand. Orally was putting pressure to buy open parking. Project is delayed by over 3.5 years. Builder without prior approval increased the asuper area of flat by 37 sq feet. Builder ready to pay 5rs/sq feet late possession charges but not interest. What should i do..

In the present matter you have two remedies.. criminal as well as consumer. You may approach the police station within which the office of the said builder is location, the police may take up further investigation and help You recover your amount. If motive is to take possession of the said property, you may go in for consumer case in the state commission (if amount is above RS. 2000000) stating the deficiency in service.

Wife filed "Evidence by way of Affidavit". Examination in chief of wife was conducted by husband's counsel. Now the turn is the reply by husband. Since the O/P had filed evidence by way of affidavit, I feel it is necessary to file reply by way of affidavit. The counsel says, in trial court affidavit- reply is not filed and that it is only done in H/C and S/C. Shall appreciate experts opinion. Thank you

Yes it is necessary to give evidence by way of affidavit in the Court. Relying on which the counsel of the Opposite Party will do your examination in the Hon'ble Court. Thus, even in Divorce cases, filing of evidence by way of Affidavit is a necessary requirement and the Court may impose costs if you don't do so on the date assigned for the same purpose.
