Gave money to colleague but he is not returning how to recover

My self and my colleague working in a govt org. Both are govt servants. He borrowed money of Rs.5 lakh from me saying he will return in a month but its been one and half years not yet returned any singly rupees. He is keep on saying i will give, but not giving so. Days passed and he simply says just wait. I am full depressed and want to take action against him. i have not got any bond paper while giving the money. I have transferred through net-banking from my account to his account. He only gave blank cheque with his signature saying that i can deposit at any time. Please suggest how to go proceed legally on this.

You have two options. One to file a civil case for recovery of money since you have proof of payment namely bank statement and cheque. Secondly, you may deposit the cheque with the amount and date filled so that your money is encashed. If the cheque bounces unpaid, you may file a cheque bounce case.

Your service regulations permit s such transaction of lending and borrowing ? if so it is reported in your annual returms. Carefully fill up the cheque present in clearing . collect the return memo file suit and make efforts to attach the salary

Hi,

Is there any cheque issued for security?. You can go to police station and file complaint u/s 420,422 ( attach the transaction proof along with complaint). If police refuse to file a FIR you may approach a lawyer for further process.
