Applied for housing loan without my permission bank deducted EMIs

07-Feb-2023 (In Recovery Law)

I applied for a Housing Loan with XYZ bank. Now the loan got approved, but without consulting me they made a cheque of the amount worth and started deducting EMI from my bank account, while the registry of the property is still pending due to the approval of the completion certificate. Are they legally committing a crime, and on asking for a refund of the deducted money they are asking for a fixed registry date - which I am unable to provide as the process of obtaining a completion certificate takes some time and no definite date is mandated by a government official. Is legal action possible?

Yes, they are committing the crime as they made the cheque of the loan amount without asking you and starting deducting EMI from your bank account, so in such case you shall have bring legal action against the bank
