Property owner not returning token money how can I claim it

Hello, I have given token money of Rs. 1,21,000 (21,000 in cash & 100,000 in cheque)to landlord but the property documents were not proper and bank was not sanctioning loan on the property. So we had to cancel this deal. We have told landlord that your property documents are not proper and without bank loan we can not take your property, hence we asked him to return our token money of Rs.1,21,000. The landlord told us that he will return my money when his flat is sold. It's almost a year now that I haven't received my money back. Is there any legal action I can take against landlord?

You can issue a legal notice to the landlord for refunding of your booking amount. If there is no response, you file a case in consumer forum against the landlord.
