Property distributed by mutual consent brother not vacating our share

Ancestral property has been divided between three brothers on mutual consent and registered in the court of law. One of the brother already staying in room, falling in other registered part is not vacating although as per registered agreement he was to vacate within nine months (december 2015) and in lieu some amount will be given once the same is vacated. Force-ably occupying and not vacating resulting in the actual legal owner is not able to construct basis amenities for living there. Even they dares for "goondas" to harm us. Kindly advice for further course of actions, please.

if you have obtained the partition orders from the court then you may file an application before the Hon'ble Court for contempt of court orders and the court may take requisite action against the offenders. you can also file a Police complaint against them for illegal possession of the property
