Procedure to gift property to own son

My father's name is second on the agreement in which he is the owner of an apartment along with y brother whose name is first. My father wishes to make a gift deed to transfer his own share to me. What documents does he need? And after the collection of documents, can the registration happen in one day? Secondly, my brother is curently living in that apartment with his family. He refuses to agree to sell the apartment, and it's impossible to divide it in meters. Once the property is partly registered on my name, and I apply for partition, how long will it take for the court to issue an order of partition by sale / auction and give us our respective shares?

Hello sir ,
You can go for gift deed ..
Your Father has right to transfer his share to anybody ....
Gift deed can do within a period of two three days ...
N thereafter you can go for partition .

For gift deed u requires original sale deed of that propertytwo witnesses n there ID proof.....n stamp duty as per the government norms ..

Ur father can gift his 50% share to u ..stampduty vl also b 200rs only ..can b registered in one day ..documents inrespect of ur fathers title inrespect of flat vl b reauired..eg.sharecertificate etc...
