05-Aug-2023 (In Property Law)
Hi, my father was the witness in the will of my brother. Its a registered property will. But my father didn't attend the court proceedings of Probate of the will as he was not interested. But we are told that the summons have been issued by the Bombay hc against my father. 1. We are also told that my father has to pay 25000 to the police as a deposit or something. Is this true? 2. And we also heard that police will take him to the court.. Is this true? Please help

Please confirm whether its a criminal case or civil case? In a civil case police will not come to your door. And even in criminal case you do not need to pay any kind of deposit. So dont worry if it is a civil case. But if it is a criminal case, police may come and take your father to court.

Sir
Court adopt a general procedure to issue summon for appearing in court
taking probate of will is civil matter and if your father has disobey the summon he may have to pay the penalty imposed by court, however he can appear and ask mercy and give valid reason for non appearance
