How to get the partition done when one legal heir is not ready for it

Sir there is my late mother in law property..There is no will,verbaly she told that one house and land should be divided into two son and other property should be divided into two son and one daughter.....Now the problem is all property papers r with my husband brother and he is not taking any step to sell them.....And my husband sister is demanding equal share in all property......
In the said situation, the sister of your husband has the right to claim her share in the property. Also, if any of the legal heir is not ready for the partition then, you can file a partition suit claiming your share in the property.
