02-May-2023 (In Property Law)
One of my friend is staying with his brother and other family members in 4th part of common family house separately (With 3 Uncle's family). His father(decreased) left this house after marrying second lady and now second lady with her children wants claim in this house saying they are also legal heir. Can the claim like this. The House and some land around is in the name of Grand mother(decreased). She divided house in four part before dying. Please advice that can my friend construct new home by demolishing their existing share of house? Can second lady and her children claim right in the new

If the property is a self acquired property of your grandmother then she has a right to divide the property according to her wish and each person can do whatever he wish to with his share in the property.
If the property is an ancestral property then the property will be divided according to Hindu Succession Act. Assuming that your friend is a Hindu
