house built on gifted land usurped by decendant of donor

30-Jan-2023 (In Property Law)

My Grandfather built a house gifted to him by his employee, wihout making any deed of the land, about 50 years ago (exact date unkown). we are paying holding tax to municipality as well as there is electric connection in name of my grand father. we were not living anymore in the house due to being posted in service. we had kept a tenant. The tenant gradualy destructed the house and approached the donee's grandchildren to sell the land to him. They sold the land alongwith the partly built house on it by registerd sale deed. when we came to know about this it was too late. what should we do?

You will need to file a suit for possession, permanent injunction and cancellation of documents (with other reliefs as applicable). This would be the only available course of action. Of course, you may also approach the local police station and in addition to the civil suit, file criminal complaints against the erring tenant.
