Compensation not received for land acquisition can I get current rate

01-Jun-2023 (In Property Law)
Part of my family property was acquired by Defence thru SLAO in 1981, and meagre compensation awarded and kept in Treasury. On return from abroad, I found out about the case. It appears the SLAO did not for our claim for higher compensation to court in the time required. On approaching civil courts in 1993, after a long time, the case was dismissed in 2008 . I was asked to find if any other cases were pending under the same area as the case could be filed under this statute but was unable. Now I would like to approach a higher court or revert for asking higher compensation at market rates.

You can exercise your option to go to the higher court with your grievance. However, you will have to explain the delay of 6 years in preferring the appeal. Unless you can explain a legitimate cause for the delay, the appellate court will not entertain your appeal. Having said that, we will not be able to guide you without complete facts, as to why the case that you filed was dismissed.
