Can property be purchased without Occupancy Certificate ?

Dear Sir, I m interested to purchase a 7th floor flat in a society at Kharghar. The society is good and has been registered. It has got CC also. The only issue is it doesnt have OC. It is a CIDCO tender plot and the builder violated some norms while constructing. Now the CIDCO wants him to seal the top 2 floors (20, & 21st) towards penalty. However instead of doing that he is ready to buy a plot nearby and hand it over to CIDCO. The matter is in court and yet to be settled. People r very confident that the verdict will go in their favour and they will get the OC. But WHEN is the question. In such situation is it worth to take risk to purchase a flat there ? Please guide me. Thanks in anticipation.

Your apprehension is right. But at the same time you have to be very practical. As you would be purchasing a flat on the 7th floor, it is unlikely that the entire building would be declared illegal. Therefore it would be worth the risk to go ahead with your deal. Good luck
