Can anyone sell an ancestral property if their name is there on taxation by nagar Nigam? Out of 3 brothers, only 2 brother's name is there on the list and 1 brother is neglected. It is an ancestral property so the neglected brother will go to civil court but in mean while can the 2 brothers sell the property?? What can the neglected brother do to stop his brothers from selling the property??

The neglected brother can file a suit for partition. He can also file a suit for injunction. If the property is in joint name of all the brothers , no one can sell out the property solely. Consent of each brother is necessary but for the safer side the neglected should file both of the cases without any further delay. Revert me . All the best.

you should be file an injunction suit for restraining the selling of property or creating any third party interest. you also advise to publish a public notice for not selling or purchasing this property by any person(s) and also said that you have neglected and by manipulation done by your brothers In the official records of the municipal authority.
