Brother built house on our share of ancestral property

our ancestral property is inherited by we 4 brothers.my elder brother has unlawfully contructed a house on the land taking in an extra portion of land that is beyond his share. now he is neither ready to give up that extra portion nor is he ready to give the value of the portion. what should we do?? pls help. i dont hav enough money to spend in his regard. pls help me out .. i am a hindu
You can file a petition in the court and get a stay order on the construction of house in your share in the land inherited by you from the ancestral property. You can claim for compensation from your brother for using your property for building the house.
