Any exemption for late payment of stamp duty

Civil court is asking to pay 9.2lakhs penalty for late payment of stamp duty to move case forward is there any exemption to pay only stamp duty without penalty or any reason to take case back and apply in high court, can I apply case in high court after case is dismissed in civil court
