29-Jun-2023 (In Family Law)
Dear Sir/Madam, I am Muslim by religion and live in Wardha, Maharashtra and I married twice after the failure of reconciliation with my first wife I have waited her to come back for 3 years but she never want to stay with me or with my family as she want to live with me only if I get separated from my old parents. When I performed second marriage then after my first wife came to know about my second marriage so, she file complained petition with the Judicial Magistrate Dhanbad Court, Jharkhand under section 498 (A) and then I was served summon at my home address from the Dhanbad Court to appear along with my 4 family memebers Then I engaged local lawyer In Dhanbad Court and he suggested to get interim relief you should file "Quash Petition" for your 4 family members which I did in the High Court Ranchi, Jharkhand and we got relief for my 4 family members. But now I have to face for the trial in the Dhanbad Court in front of Judicial Magistrate. Now can I file Quash Petition?

You have quashed the fIR which was filed against your family members. Yes you can file quashing petition on ground of parity and if that is not entertained then you can file for discharge in the trail court
